These Rental Terms and Conditions provide a general summary of Music & Arts rental terms. By entering into a rental transaction with Music & Arts, you agree to the terms in your rental agreement, state-specific disclosures, and any other documents provided to you in connection with your rental. Because rental terms may vary by state, product type, and transaction type, your signed rental agreement and applicable law will control if there is any inconsistency with this summary.
Music & Arts offers instrument rentals that may include an initial trial period followed by recurring rental payments. After the initial trial period, you may return the instrument or continue renting by making the required renewal payments, subject to the terms of your specific agreement.
Music & Arts retains title to the instrument unless and until you satisfy the ownership terms in your agreement. Customers may be able to acquire ownership by making all required payments or, where available, by exercising an early purchase option. In some cases, customers may also be able to apply accrued equity toward the purchase of certain instruments, subject to the terms of the applicable agreement, product eligibility, and state law.
Your total rental cost may include recurring rental payments, applicable taxes, and, where allowed, other charges such as late fees, returned-payment fees, optional damage-waiver charges, and other amounts described in your agreement. Fees, timing, and amounts may vary by state.
You are responsible for the instrument while it is in your possession, except to the extent limited by your agreement. You may be liable for loss, theft, destruction, or damage beyond normal wear and tear. You are also responsible for returning required accessories issued with the instrument or paying applicable charges if they are missing or damaged.
Music & Arts may offer an optional Liability Damage Waiver (“LDW”) for an additional fee. LDW is optional, may not be available on all instruments or in all states, and generally must be selected at the start of the rental if available. LDW coverage, exclusions, repair procedures, theft requirements, and state-specific notices vary by contract. In general, LDW does not cover every type of damage or loss, and coverage may be void if your account is past due or if other conditions are not met. Please review your agreement carefully for complete details.
Music & Arts may require that repairs be performed only through Music & Arts or an approved technician. If damage is not covered under LDW, standard repair charges may apply.
You may generally terminate your rental by returning the instrument in good condition, reasonable wear and tear excepted, together with any required accessories. You remain responsible for any accrued unpaid amounts, missing items, repair charges, or other obligations that apply under your contract. Do not leave an instrument at a school or other location without following Music & Arts return instructions and obtaining confirmation of return, if required.
If you fail to make required payments or otherwise breach your agreement, your rental may terminate or go into default, subject to any notices, cure periods, reinstatement rights, and limitations required by state law. Where permitted, Music & Arts may exercise legal remedies to recover the instrument and collect unpaid amounts, fees, costs, and other damages. Any state-specific notice, fee cap, cure right, reinstatement right, or other consumer protection stated in your agreement, or required by applicable law, will govern to the extent applicable.
Some rentals may require a security deposit. If a deposit is collected, it may be applied to unpaid balances or other amounts owed under the agreement. Any refund timing, deductions, and deposit-handling rules will be governed by your contract.
Your rental may be subject to state-specific rights and disclosures. Please review your rental agreement and all state-specific documents provided with your transaction carefully.
